This Hold Harmless Agreement ("Agreement") is entered into on [Date] by and between Sunset Cove Country Club ("Club"), located at 1100 Jordan Point Rd, Prince George VA 23860, and applying member, located at [Address listed on application] ("Party").

WHEREAS, the Party desires to use the Club's facilities and participate in Club activities, events, and programs, including the pool area; and

WHEREAS, the Club is willing to allow the Party to use its facilities and participate in its activities, events, and programs, subject to the terms and conditions of this Agreement.

NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties agree as follows:

1. Hold Harmless. The Party hereby agrees to indemnify, defend, and hold harmless the Club, its officers, directors, employees, and agents, from and against any and all claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with the Party's use of the Club's facilities and participation in its activities, events, and programs, including the pool area, whether caused by the Party's negligence or otherwise.

2. Waiver of Liability. The Party hereby acknowledges and agrees that the Club shall not be liable for any injuries, damages, or losses of any kind arising out of or in connection with the Party's use of the Club's facilities and participation in its activities, events, and programs, including the pool area, whether caused by the Club's negligence or otherwise.

3. Release of Claims. The Party hereby releases and discharges the Club, its officers, directors, employees, and agents, from any and all claims, demands, causes of action, and liabilities of any kind arising out of or in connection with the Party's use of the Club's facilities and participation in its activities, events, and programs, including the pool area.

4. Pool Area Rules. The Party hereby agrees to comply with all pool area rules and regulations established by the Club, including but not limited to rules regarding the supervision of minors, use of personal flotation devices, and pool hours.

5. Insurance. The Party hereby agrees to maintain appropriate insurance coverage for any activities, events, or programs conducted at the Club's facilities, including the pool area, and to provide the Club with proof of insurance upon request.

6. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Virginia, without giving effect to any principles of conflicts of law.

7. Entire Agreement. This Agreement contains the entire understanding of the parties with respect to the subject matter hereof and supersedes all prior negotiations, discussions, and agreements between them.

8. Binding Effect. This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns.
